1. Organisers
The organiser of the Digital Photographer of the Year Awards 2009 is Imagine Publishing. Employees of Imagine Publishing, their relatives or any agents, sponsors or associates relating to the Awards are not eligible to enter.
2. Eligibility
The Awards are open to anyone over 18 years of age but a maximum of one entry per category per person is allowed. This excludes the ‘Overall’ category.
The Student category is open to anyone 18-25 and studying a photography related full-time course.
Images that have already been awarded a prize in a national or international competition or been used for commercial purposes are not eligible.
All entrants agree to participate in publicity in connection with these Awards.
3. Display of entries
By submitting images to Digital Photographer of The Year, each entrant confirms that:
a) they are the sole author of each entry and that it is their original work;
b) they own the copyright and any other intellectual property rights of each image;
c) they have the permission of those pictured in the image (or, where the image shows any persons under 18, the consent of their parent/guardian) for the usage rights required by clause 4 and will indemnify Imagine Publishing against any claims made by any third parties in respect of such infringement;
d) they have not licensed or disposed of any rights in the image that would conflict with uses to be made by Imagine Publishing (see clause 4); and
e) they have received any necessary permissions from the owner(s) of buildings included in submitted images for the usage rights required by Imagine Publishing in clause 4 and will indemnify Imagine Publishing against any claims made by any third parties in respect of such infringement.
4. Imagine Publishing wishes to promote the awards in as many ways as possible and give maximum exposure to the entrants, shortlists and winners:, therefore the following is necessary for all entrants. By entering the competition, you grant Imagine Publishing, its partners and its sponsors a non-exclusive, royalty free right to reproduce, enlarge, publish or exhibit, on any media, the images for any purpose connected with the competition. This may include, but is not limited to:
a) inclusion in the Digital Photographer awards bookazine;
b) on the Digital Photographer website (www.dphotographer.co.uk) and on the websites of sponsors;
c) for use in press releases to be distributed to national, regional & specialist press giving information about or promoting the competition
d) inclusion in Digital Photographer magazine and its editions
5. Image editing
You may use image enhancement to optimise an entry for the Awards, although you are not allowed to add or remove significant elements.

Student Digital Photographer of the Year
Landscape Photographer of the Year
Portrait Photographer of the Year
Wildlife Photographer of the Year
Black and white Photographer of the Year
Macro Photographer of the Year
Sports Photographer of the Year
Wedding Photographer of the Year
Urban Photographer of the Year
Closing date for all entries is 5 November 2009.
Winners announced online and in issue 91 of Digital Photographer magazine on January 2010.
7. Judging
Imagine Publishing will appoint a judging panel to short list entries and winners in each category. The decision of the judges is final and the organisers will not enter into any correspondence regarding the judging or organisation of the Awards.
8. Notification
Winners within each category will be announced on the website and in the magazine in January 2010. The overall winner of Digital Photographer of the Year 2009 will also be announced on the website and in issue 91 of the magazine.
9. Prizes

Imagine Publishing and its partners reserve the right to substitute prizes with a comparable alternative. Prizes are non transferable and no cash equivalent will be offered.
Winners should allow 90 days for receipt of their prizes.
10. Copyright
The entrant must be the owner of copyright, intellectual property, and all other proprietary rights in all pictures entered. This includes model release forms where applicable. It is the legal responsibility of the entrant, and not the organisers, to ensure they comply with copyright requirements and own the rights to reproduce their images. Entries that do not fulfil these criteria will be deemed ineligible and disqualified
The photographer will retain copyright and where an image is reproduced, the photographer will be credited.
The organisers reserve the world-wide royalty free right to reproduce the prize-winning images on, or in relation to, Digital Photographer of the Year.
11. Liability
Images are uploaded at the photographer’s risk and the organisers regret they cannot accept any liability for the unauthorised duplication or use of images submitted to the website.
